Terms & Conditions

To make sure we all understand the terms under which we are doing business, we are obliged to set out the following ‘Terms and Conditions’ between us:

Definitions

Seller – means Chocolato Ltd.

Buyer – means you, the person who is hiring the product/services from us Even if you are hiring on someone else’s behalf.

Delivery Charge – means a charge that is payable by you to us for the delivery of the item/service.

Fountain – means Chocolate Fountain.

Term – means the day of hire.

General Booking Terms

A booking is made and a contract formed when the Seller receives a booking form from the Buyer along with a non-returnable deposit, and we confirm that booking to you. The booking form must be filled in correctly and supplied to us within 14 days.

Once the Seller has received the booking form from the Buyer, the Seller will confirm your booking along with a Confirmation Letter.

The Seller will not take responsibility for any delay in reaching any venue due to road works, traffic chaos or any other highway hazard.

Payment

Full invoice balance to be cleared 28 days before the date of the hire unless agreed with the Seller.

Cancellation Policy

The Buyer must make cancellations in writing by email to info@chocolato.co.uk

Should the Buyer call or text or email to cancel the booking 14 days before the booking is to take place then the Buyer must pay 50% of the Seller fee. All deposits are non-returnable. THERE ARE NO EXCEPTIONS TO THIS.

Should the Buyer call or text or email to cancel the booking 7 days before the booking is to take place then the Buyer must pay 100% of the seller fee. All deposits are non-returnable. THERE ARE NO EXCEPTIONS TO THIS.

Should the British Government impose a lock down on the date of the event all monies paid will be refunded in full.

However, if the event is still allowed to take place by law, but with a reduced number of guests, then all deposits are non-returnable. THERE ARE NO EXCEPTIONS TO THIS.

Breakdown of Chocolate Fountain

In the unlikely event that the Fountain should break down or fail to work, the bowl of the Fountain will be filled with chocolate, and therefore still provide the guests with the experience.

The Seller will refund to the Buyer 25% of the full hire charge. The Buyer agrees that the maximum claim that could be made in respect of loss or damage is restricted to the total cost of the hire and no more.

Equipment Breakdown

In the unlikely event that our any of our equipment does not work for the entire booking period of the hire time for any reason all monies paid will be refunded in full.

If any of our equipment stops working for any reason after the start time of the hire and we cannot continue the booking the Seller will refund part of the booking cost. The Buyer agrees that the maximum claim that could bemade in respect of loss or damage is restricted to the total cost of the hire and no more.
 
General

The Contract is between the Seller and the Buyer as principals and may not be reassigned by the Buyer without the express written consent of the Seller.

These ‘Terms and Conditions’ form the whole agreement between the Seller and the Buyer and shall not be removed or varied in any way.

If the Seller is in default of any of their contractual obligations, the Seller shall not be liable where such default is due to any unforeseeable event (e.g. act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest) beyond the reasonable control of the Seller. In such circumstances, the Seller shall give notice to the Buyer where possible, and be released from any obligations prevented or restricted by the said event.

These ‘Terms and Conditions’ are subject to English Law and the Buyer consents to the exclusive jurisdiction of the English courts in all matters regarding the Services. It is not the intention of the parties to confer any rights contained in The Contracts (Rights of Third Parties) Act 1999 on any hire parties referred to herein, and any such rights, which may otherwise be implied, are hereby excluded.
